Permits, not chips, now decide where AI capacity lands. Sydney lost a 90MW campus to policy risk the same week Meta signed for GPU space in Indonesia.
Goodman withdrew its application for Project Mars, a 90MW, AU$1.2B data center in Sydney's Lane Cove, on Sept 28. It cited a changed policy and regulatory environment. The council said 374 public submissions came in, only 9 in support, and it wants a pause on new AI data center applications.
On Sept 29 Meta agreed to lease AI capacity from Firmus in Southeast Asia, including a 170,000 GPU campus planned for Batam. Firmus reports more than 900MW contracted. The same day Samsung put $1B into KKR's Helix platform, which now has more than $10B committed. Money is moving to sites that can get approved and powered.
The layer moving is regulation. Approval risk now prices a site as much as power does. Distribution Capture governs: owners of permitted, powered land set terms. Confidence is Low because one withdrawal is a single case and the federal Australian review is still open.
