Permits, not tenant demand, now set AI campus credit risk. Oracle's force majeure on Project Jupiter pushes delay cost onto developers and their lenders.
Oracle sent a force majeure notice to Blue Owl's STACK unit on Project Jupiter, reported Sept 24. The New Mexico Stargate campus is about 2.5 GW with up to $165B planned. The notice lets Oracle delay lease payments if the 2028 start slips. The gas pipeline moved about six months to Feb 1, 2027 and the fuel cell air permit is due by Nov 23. Oracle says the project is on schedule.
Lenders priced the risk. The $18B of project loans trade at 89 to 91 cents, Searchlight New Mexico reported Sept 25. Axios put Oracle's 2055 bonds at 77 cents. On Sept 25 Crusoe dropped its $1.25B order for 29 Boom turbines, 1.2 GW of planned onsite power. On Sept 28 Nvidia added $150B to its buyback.
The mechanism: tenants with legal cover hand timing risk to the landlord. Developers and banks funded against a 2028 rent start now carry the permit calendar. Cash stays with the chip seller. The layer moving is capital. The governing signal is Capital Flood.
