JUDGMENT OF RECORD ·
Carriers no longer hold the only regulated path to the phone. The FCC cleared SpaceX for 15,000 satellites that reach handsets on its own spectrum.
On Oct 6 the FCC approved SpaceX's plan for 15,000 direct-to-device satellites in nine shells at 326 to 335 km. Half must operate by Oct 7, 2032 and all by Oct 7, 2035. SpaceX will use mobile satellite spectrum bought from EchoStar, so it need not rent a carrier's airwaves. Launches start next year. Some bands were deferred, and full rights wait on the EchoStar transfer near Nov 30, 2027.
The carriers moved first. AT&T, T-Mobile and Verizon formally set up a joint satellite venture on Oct 2, still relying on other operators' satellites. On Oct 7 AST SpaceMobile fell 3.91%. Also on Oct 7, OpenAI began rolling out an interactive visual interface in ChatGPT tied to a new GPT-6 model.
The layer moving is distribution. A device maker or satellite operator can now sell connectivity without a carrier contract, so the subscriber relationship is contestable. Distribution Capture governs. Confidence is Medium: the order is public, but no satellites, prices or subscribers exist yet.

WHAT WOULD PROVE THIS WRONG
SpaceX launches no second-generation Starlink Mobile satellites by Dec 31, 2027, or sells its handset service only through a carrier partner when it launches.
