JUDGMENT OF RECORD ·
The default assistant slot on EU Android phones is becoming contestable. Google's appeal does not pause the 2027 deadlines, and rival agents are ready to fill it.
Google filed two cases at the EU General Court, reported Sept 29, against the July Digital Markets Act orders. One makes Android give rival AI assistants the same system hooks as Gemini, due August 2027. The other makes Google share search data with rival engines, including chatbots, from January 2027. EU appeals do not suspend orders unless a court grants interim relief.
The same day OpenAI used DevDay to launch Dots, always on agents that act across more than 4,000 connected apps, plus Sign in with ChatGPT with 16 partners. OpenAI announced no revenue share. Rival assistants now have products that could use Android system access.
The layer moving is regulation. The EU is prying open the assistant entry point on about 60% of EU phones. Distribution Capture governs. Confidence is Medium: the filing rests on press reports and interim relief could stall it.

WHAT WOULD PROVE THIS WRONG
The General Court grants Google interim relief suspending the Android order before August 2027, or the Commission pushes the Android deadline past 2027.
