Pentagon AI buying now rewards vendors that accept any lawful use. An appeals court let DoD treat a model maker's usage limits as a supply chain risk.
The DC Circuit upheld the Pentagon's supply chain risk designation of Anthropic on Sept 25, 2 to 1, under Section 4713. The majority said the company's restrictions had stopped its model from doing tasks government users requested. Judge Henderson dissented. A California district court ruled a parallel designation unlawful in August, so the courts are split. Anthropic says it is considering further review.
Nextgov said Sept 28 the ruling will likely keep DoD and its contractors cutting use of the company's tools. Buyers are also asking for model choice. On Sept 25 Thales said it is in advanced talks with NATO countries on HexaForce, a command overlay that lets users pick their AI models. The same day Ukraine opened its 5 million frame combat dataset to up to a dozen UK firms.
The mechanism: the buyer can now exclude a supplier over contract terms, so vendors will align usage policies to the customer. The layer moving is regulation. The governing signal is Distribution Capture.
